RE: The tariff classification of watches from Switzerland

Dear Ms. Piercy:

In your letter dated November 9, 1999, on behalf of R.L. Massey Ltd., you requested a tariff classification ruling.

The Saro-Gem watches are quartz analog watches with batteries. The models for which you are requesting a ruling include the Integral Dome bi-colored chrome and gold watch, the Integral Dome blue watch and the Carat Jubile green watch. These watches contain seven jewels in their movements, have cases and bracelets made of stainless steel, and sapphire crystals. The Integral Dome bi- colored chrome and gold watch has a case which is gold plated. The Integral Dome blue watch is coated by titanium nitrid and the Carat jubilee is coated by titanium nitrid.

The applicable subheading for the Integral Dome bi-colored chrome and gold watch will be 9102.11.50, Harmonized Tariff Schedule of the United States (HTS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101; wrist watches, electrically operated, whether or not incorporating a stop watch facility; with mechanical display only; other; with strap, band or bracelet of textile material or of base metal, whether or not gold- or silver-plated; with gold- or silver-plated case. The rate of duty will be 80 cents each plus 6 percent on the case plus 14 percent on the strap, band or bracelet plus 5.3 percent on the battery.

The applicable subheading for the Integral Dome blue watch and the Carat Jubile green watch will be 9102.11.65, Harmonized Tariff Schedule of the United States (HTS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101; wrist watches, electrically operated, whether or not incorporating a stop watch facility; with mechanical display only; other; with strap, band or bracelet of textile material or of base metal, whether or not gold- or silver-plated; other. The rate of duty will be 76 cents each plus 8.5 percent on the case plus 14 percent on the strap, band or bracelet plus 5.3 percent on the battery.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
